• Chronic nausea or cyclical vomiting syndrome that has proven resistant to other conventional medical treatments; and
  
• Post-traumatic stress disorder. ​

• ​An applicant must use the applicable registry identification card application form made available through the website for the Kentucky Medical Cannabis Program here.
  
• Registry identification card applications submitted by or on behalf of qualified patients must include:
  
• The full name, address, telephone number, email address, date of birth, social security number, and driver's license number of the qualified patient;
  
• A written certification issued by a medical cannabis practitioner;
  
• The name, address, and telephone number of the qualified patient's medical cannabis practitioner;
  
• Pay the application fee for a qualified patient ($25); and
  
• A notarized signature page signed by the applicant that includes a statement by the qualified patient pledging not to divert medical cannabis to anyone who is not permitted to possess medical cannabis.

• Yes, patients under 18 can use medical cannabis in Kentucky if they meet the following criteria:
  
• Are a resident of Kentucky, have a qualifying medical condition and obtained a written certification from a registered medical practitioner to use medical cannabis, and has not been convicted of a disqualifying felony offense.
  
• Obtained additional documentation of a diagnosis of a qualifying medical condition from a practitioner other than the medical cannabis practitioner who provided the written certification.
  
• Have a custodial parent or legal guardian who agrees in writing to allow the minor patient to use medical cannabis, serve as their designated caregiver, and control the acquisition, dosage, and frequency of use of medical cannabis.
  
• Once patients under 18 meet these criteria, they can follow the same steps as a registered qualified patient to obtain a medical cannabis card in Kentucky.  This includes submitting the required application, documentation, and fee to the program.
  
• Patients under 18 should also check with their schools regarding any specific restrictions or policies related to the possession and use of medical cannabis on school premises.
  
• Further, SB 47 only allows cardholders over the age of 21 to purchase products intended for consumption by vaporizing.​
  

• Th​e patient must meet the same requirements as above but must provide an address where they can be reached.​
  

​​

• ​Medical cannabis practitioners may begin the process to become authorized by their state licensing boards on or around June 5, 2024.  Once authorized, patients who are interested in getting a written certification for medical cannabis should contact an authorized medical cannabis practitioner and set up an appointment.
  
• Additionally, a list of authorized medical practitioners will be available on our website after they become authorized throu​gh their respective licensing board.​

• A bona fide practitioner-patient relationship, as defined by KRS 218B.010(1)​, means a treating or consulting relationship, where the medical cannabis practitioner has:
  
• Completed an initial in-person visit with the patient;
  
• Consulted the patient on possible medical, therapeutic, and palliative properties of medical cannabis;
  
• Advised the patient of the possible risks and side effects of medical cannabis, including possible interactions between medical cannabis and other medications the patient is taking at that time; and
  
• Established an expectation that the medical practitioner will provide follow-up care and treatment.
  
• After the initial in-person visit, a bona fide practitioner-patient relationship can be maintained via telehealth.​

• The medical cannabis practitioner's full name, license type, license number, office address, telephone number, and email address;
  
• The qualified patient's full name, date of birth, and social security number;
  
• If the qualified patient is a minor, the custodial parent or legal guardian's full name, date of birth, social security number, email address, and phone number;
  
• Identification of the diagnosed qualifying medical condition;
  
• Attestations that the medical practitioner has:
  
• Established a bona fide practitioner-patient relationship with the patient;
  
• Diagnosed the patient, or confirmed a diagnosis, with a qualifying medical cannabis condition which the medical practitioner believes the patient may received therapeutic or palliative benefit from the use of medical cannabis;
  
• Reviewed a report of prescriptions from the last 12 months from the Kentucky All Schedule Prescription Electronic Reporting (“KASPER") system;
  
• Consulted with the patient, or patient's custodial parent or legal guardian, the possible risks and side effects of medical cannabis, including possible interactions between medical cannabis and other medications the patient is taking at that time; and
  
• Obtained the consent of the patient's custodial parent or legal guardian responsible for providing consent to treatment if the patient is a minor; and
  
• The medical cannabis practitioner's signature and the date signed.​
  

​

• ​​An initial written certifications for medical cannabis will be valid for 60 days.  The issuing medical cannabis practitioner may renew an initial written certification up to 3 additional 60 day periods.
• After that, the medical cannabis practitioner may issue another initial written certification to the patient only after an in-person examination or an examination conducted via telehealth of the patient.
  
• A subsequent written certification issued to renew a registry identification card is valid for 90 days.​​

• ​​Once you've submitted your application, the program will approve or deny your application within 30 days of receiving a completed application.  The actual issuance of the ID card will occur within five (5) days of approval.​​

• ​$25. ​​

• An applicant must use the applicable registry identification card application form made available through the website for the Kentucky Medical Cannabis Program here.
  
• A qualified patient will be able to capture their written certification electronically as part of filling out their application.
  
• An applicant must submit a notarized signature page along with his or her application.  The applicable notarized signature page is available on the program's website here​. ​

• Your personal information will be protected as required by KRS 218B.135​ with strict confidentiality measures in place.​
  

​

• Yes.  Under KRS 218B.040​, you can be dismissed from your job for using medical cannabis onsite if your employer does not allow it.  Your employer can restrict its use in the workplace and may take action if it poses a safety risk.  Violating workplace policies could impact unemployment and other benefits.​​

• We​ are not aware of any insurance that will cover medical cannabis, but patients are encouraged to contact their providers.​
  

​

• ​​The program anticipates that medical cannabis products will be available for purchase at licensed dispensaries in 2025.
  

• ​​​​One (1) year, unless the medical cannabis practitioner who issued the written certification indicates that the expiration date needs to be earlier.

• A patient's card, if they do not have a designated caregiver, will include their name, date of birth, address, issue date, expiration date, an identification number, a bar code, and a telephone number and website address for the Kentucky Medical Cannabis Program.
  
• If a cardholder is under the age of 18, there will be a clear and obvious identifier indicating that the cardholder is a minor.​
  

​

• If a cardholder has a designated caregiver(s), the patient's card will have all of the information above and also include their designated caregiver(s) identification number(s). ​​
  

• Yes.  A registered qualified patient must notify the cabinet ​if they wish to terminate a designated caregiver relationship with an individual who has been designated as their caregiver.
  
• Upon receiving this type of notification, the cabinet will notify the designated caregiver in writing that they are no longer a designated caregiver for the patient. ​
  

• An uninterrupted thirty (30) day supply of medical cannabis for cardholders consists of 112 grams of raw plant material, 28 grams of concentrate, or 3,900 milligrams of THC i​nfused into a medical cannabis product such as an edible.  An uninterrupted ten (10) day supply of medical cannabis for cardholders consists of 37.5 grams of raw plant material, 9.5 grams of concentrate, or 1,300 milligrams of THC infused into a medicinal cannabis product.​​
  

• ​Allowable medical cannabis products include edibles, oils, tinctures, vapes, and raw plant material. Registered cardholders under 21 years of age may not purchase or use vaping products.
  
• Additionally, SB 47 prohibits Kentuckians from consuming raw plant material by smoking.  SB 47 also requires that all raw plant materials packaged in the Commonwealth be labeled as “ not intended for consumption by smoking."​​

• ​A registered qualified patient may purchase a 30 day supply of medical cannabis during a given 25 day period. ​​
  

• A registered qualified patient may keep a 30 day supply of medical cannabis at their residence, per KRS 218B.025​.​
  

​

• A registered qualified patient may keep a 10 day supply ​of medical cannabis on his or her person, per KRS 218B.025.  All medical cannabis possessed by a cardholder outside of his or her residence must be kept in the original container in which the cardholder received the medical cannabis from a dispensary.  When a cardholder possesses medical cannabis outside of his or her residence, the cardholder must also be in possession of a valid registry identification card issued by the cabinet or, for visiting qualified patients, a valid out-of-state registry identification card and documentation of having been diagnosed with a qualifying medical condition.​
  

• Registered qualified patients may transport a 30 day supply of medical cannabis from a dispensary to their residence if the medical cannabis is contained in a sealed package that requires at least a two-step process for initial opening. ​​​

• A reg​istered cardholder must notify the cabinet of any change in their name or address. ​
  

​

• A registered qualified patient must notify the cabinet within 30 days if they no longer suffer from the qualifying medical condition they had a written certification for. ​​​
  

​

• If a registered patient loses their registry identification card, they must notify the cabinet within ​10 days of realizing the card has been lost. ​
  

​

• The cabinet will issue a new registry identification card within 10 days of receiving notice.​​
  

​

• The cardholder sells, distributes, or dispenses medical cannabis to a person who is not permitted to possess or use medical cannabis under KRS Chapter 218B;​ or
  
• The cardholder knowingly commits multiple violations or a serious violation of KRS Chapter 218B​ or 915 KAR Chapter 2. ​​

• ​​​The cabinet shall provide written notice via certified mail to the cardholder of revocation of their registry identification card.

• ​The cardholder may, within 30 days after the date of the mailing of the cabinet's notice, file a written request for ​an administrative hearing regarding the revocation. The hearing will be conducted in compliance with the requirements of KRS Chapter 13B​. ​​

• ​​A registered qualified patient may apply to renew their card by submitting the applicable renewal application to the cabinet no later than 30 days prior to the expiration date on the card.  The renewal application form will be made available through the website for the Kentucky Medical Cannabis Program.​​

​

• ​​​​Your registry identification card will no longer be valid beyond the expiration date. 

• Medical cannabis products may be returned to a licensed dispensary for destruction. ​​
  

​

• 18.  However, a dispensary shall not permit an individual who is not a cardholder to enter or remain on its premises except under certain circumstances. See KRS 218B.095(6) and 915 KAR 1:070​, Section 10.
  

​

• ​Yes, patients under 18 can apply for a registry identification card in Kentucky if they meet the following criteria:
  
• Have a qualifying medical condition and obtained a written certification from a registered medical practitioner to use medical cannabis.

• A written certification form for minors has all of the same i​nformation as all other patients and includes the consent of the patient's custodial parent or legal guardian responsible for providing consent to treatment.  A minor can obtain a written certification from a medical cannabis practitioner.​

• Yes.  The cabinet shall not issue a valid registry identification card to a minor qualified patient unless the designated caregiver application for the custodial parent or legal guardian with responsibility for health care decisions for the minor qualified patient is approved. ​​​

• In addition to other identifying information, there will be ​a clear and obvious identifier indicating that you are a minor as well as the identification number for your designated caregiver.​

• A designated caregiver must be a resident of Kentucky, at least 21 years old, has not been convicted of a disqualifying felony offense, and has agreed to assist no more than three (3) registered, qualified patients.
  
• Any person who has been appointed as a guardian, limited guardian, conservator, or limited conservator must also be eligible to be designated as a designated caregiver by the individual for whom they have been appointed as a guardian, limited guardian, conservator, or limited conservator.
  
• For minor patients, the custodial parent or legal guardian with responsibility for health care decisions for the qualified patient must serve as the designated caregiver for the minor patient.​
  

• Provide your name, address, telephone number, email address, and date of birth to the qualified patient who wants to designate you as their caregiver
  
• The qualified patient must designate you as a caregiver in their application for a registry identification card and that application must be approved.
  
• Once the qualified patient's application is approved, you may submit an application to be the registered qualified patient's designated caregiver.  This application form will be available through the website of the Kentucky Medical Cannabis Program and you will need to provide your name, address, telephone number, email address, date of birth, social security number, and driver's license number as well as the name and registry identification card number of the qualified patient who designated you to be their caregiver.  Your application must include a signed and notarized signature page (available here) stating that you agree to be the registered qualified patient's caregiver and will not divert medical cannabis to anyone other than the registered qualified patient to whom you are connected through the cabinet's registration process.​
  

• ​​$25 per application. 
  

• Subject to a limited exception in KRS 218B.055(3)(b)​, a caregiver may only assist up to 3 registered qualified patients at a given time.​
  

• A designated caregiver may purchase medical cannabis​ at a dispensary on behalf of each registered qualified patient that he or she has been approved to assist. ​​
  

• ​A designated caregiver may have no more than a 30 day supply of medical cannabis at their residence for each registered qualified patient that he or she has been approved to assist, per KRS 218B.025.​ 
  

​

• ​A designated caregiver may keep a 10 day supply of medical cannabis on his or her person for each registered qualified patients that he or she has been approved to assist, per KRS 218B.025​.  All medical cannabis possessed by a cardholder outside of his or her residence must be kept in the original container in which the cardholder received the medical cannabis from a dispensary.  When a designated caregiver possesses medical cannabis outside of his or her residence, the designated caregiver must also be in possession of their valid registry identification card issued by the cabinet.

• Does not provide all information in their application;
  
• Previously had a registry identification card revoked;
  
• Provided false information;
  
• Was previously convicted of a disqualifying felony offense; or
  
• Has applied to be a designated caregiver for a qualified patient whose application for a registry identification card has been denied. ​

• If the re​gistered qualified patient that the designated caregiver is connected to in the registry has been approved to renew their card, the designated caregiver may apply to renew their card by submitting the applicable renewal application to the cabinet.  The renewal application form will be made available through the website for the Kentucky Medical Cannabis Program.​

• A designated caregiver must notify the cabinet within 30 day​s of becoming aware of their registered qualified patient's passing or no longer suffering from the qualifying medical condition he or she received their written certification for. ​

• Medic​al cannabis products may be returned to a licensed dispensary for destruction.​

• Yes, if you meet the following criteria:
  
• You are not a resident of Kentucky or have been a resident for less than 30 days.
  
• You are at least 21 years of age.
  
• You have not been convicted of a disqualifying felony offense.
  
• You possess a valid out-of-state registry identification card.
  
• You have documentation of having been diagnosed with a qualifying medical condition.
  
• Once you meet these criteria, you can follow the same steps as a registered qualified patient to obtain a registry identification card in Kentucky. This includes submitting the required application, documentation, and fee to the program. ​
  

• A visiting qualified patient must submit the following with their application:
  
• The full name, address, telephone number, email address, date of birth, social security number, and driver's license number of the visiting qualified patient ;
  
• A copy of their valid out-of-state registry identification card;
  
• Proof that they have been diagnosed with a qualifying medical condition;
  
• The application fee for a registry identification card for visiting qualified patients; and
  
• A notarized signature page that includes a statement, signed by the visiting qualified patient, pledging not to divert medical cannabis to anyone who is not permitted to possess medical cannabis.  The applicable notarized signature page is available on the program's website here.​

• The visiting qualified patient must meet the same requirements as above but must provide an address where they can be reached.​​

• ​A visiting qualified patient may only have up to a 10 day supply of medical cannabis on their person at any given time.  All medicinal cannabis possessed by a visiting qualified patient outside of where he or she is staying must be kept in the original container in which the visiting qualified patient received the medical cannabis from a dispensary.  When a visiting qualified possesses medical cannabis outside of where he or she is staying, the visiting qualified patient must also be in possession of their valid registry identification card issued by the cabinet or their valid out-of-state registry identification card and documentation of having been diagnosed with a qualifying medical condition.​

• ​Yes.  The requirements to renew a registry identification​ card as a visiting qualified patient are the same as initially applying for one. ​
  

• ​Yes.  An application submitted by a visiting qualified patient may be denied by the cabinet for several reasons, including:
  
• Not providing all necessary information and documentation;
  
• Previously having a registry identification card revoked;
  
• Providing false information; or
  
• Does not meet the eligibility requirements.
  

• If a visiting qualified patient loses their registry identification card, they must notify the cabinet within 10 days of realizing the card has been lost. ​​
