Which medical practitioners are approved to certify patients to receive medical cannabis cards and prescriptions?
Registered physicians, osteopaths, and advanced practice registered nurses ("APRNs") who are first authorized by their respective licensing board.
How can a physician or APRN become certified as a medical cannabis practitioner?
Physicians, osteopaths, and APRNs will need to apply to the same state licensing board that issued their professional practice license.
How will physicians and APRNs be able to issue medical cannabis cards to patients?
They must have a bona fide practitioner-patient relationship with the patient and either diagnosed, or confirmed the diagnosis of, the patient with a qualifying medical condition and confirmed that the patient could benefit from the use of medical cannabis.
Practitioners must also explain to patients the possible risks and side effects associated with medical cannabis use.
If the patient is under the age of 18 the practitioner must also consult with the patient's parent or guardian about risks and obtain consent to treat.
What is a bona fide practitioner-patient relationship?
A bona fide practitioner-patient relationship is defined in KRS 218B.010(1) and requires an initial in-person examination and assessment of a patient's medical history and current medical condition among other requirements. The ongoing relationship can be maintained via telehealth.
Will there be required training(s) for medical practitioners who are authorized to write written certifications for medical cannabis cards?
Yes.
