ZONING LAWS FOR MEDICAL CANNABIS

Kentucky's medical cannabis laws provide that a cannabis business shall not be located within one thousand (1,000) feet of an existing elementary, secondary school, or daycare center. The Program defines "Daycare center" as any "child-care center" as defined by KRS 199.894(3), any "family child-care home" as defined by KRS 199.894(5), and any registered childcare providers in the Child Care Assistance Program as regulated by 922 KAR 2:180.

The Program measures one thousand (1,000) feet as a straight line from the nearest property line of an existing elementary school, secondary school, or daycare center to the nearest property line of the proposed place of business.

Local governments may impose additional zoning limitations for cannabis businesses.

THE ZONING TOOL LIMITATIONS

The Program does not have access to the physical boundaries of elementary schools, secondary schools, or daycare centers. As a result, this tool measures only from the physical address of the school or daycare. Because there is natural geo-variance between a measurement from a physical address and a measurement from a property line boundary, the Program has added an additional 500-feet to the measurement.

Accordingly, this zoning tool assists with evaluating whether the proposed cannabis business is located within 1,500 feet of the physical address of a:

  • A public school;
  • A non-public school certified by the Kentucky Department of Education (KDE); or
  • A daycare center.

Please note that this tool contains a listing of non-public schools that are certified by KDE. However, this tool does not contain an exhaustive listing of all non-public schools in the Commonwealth. Non-public schools are not required to be certified by the KDE, and KDE does not have records for non-public schools that do not certify with the KDE.
