Medical Cannabis vs. Hemp
What is the difference between medical cannabis and hemp?
Medical cannabis is considered a Schedule I drug on the federal Controlled Substances Act, while hemp was removed from this list via the 2018 Farm Bill.
Cannabis, or marijuana, is legally defined as Cannabis sativa L. that has more than 0.3% THC by dry weight, while hemp has less than 0.3% THC by dry weight.
The primary cannabinoid in hemp flowers is CBD, or Cannabidiol, an ingredient found in health and wellness products.
Parts of the hemp plant (other than flowers) can also be used to produce other products such as hemp seed for food consumption and fiber for construction, textiles, and more.
Are hemp farmers able to also grow medical cannabis?
Yes, hemp farmers, like any other cultivator applicant, may apply to receive a medical cannabis license. If awarded a license, hemp farmers may grow medical cannabis indoors; medical cannabis may not be grown outdoors.
All cultivators must adhere to the requirements in
KRS Chapter 218B
and the Program's regulations, which you can find
